Section 16.01. District Attorney; Election; Term; Qualifications.

There shall be a District Attorney, who shall be elected from the County at large for a term of four years beginning with the first day of January next following his election. At the time of his nomination and election, and throughout his term of office, the District Attorney shall be and remain a qualified elector of the County and shall be and remain duly licensed and entitled to practice law in the State of New York.

Section 16.02. District Attorney; Powers and Duties.

Except as may otherwise be provided in this Charter, the District Attorney shall have all the powers and perform all the duties conferred or imposed by law upon district attorneys, and perform such other and related non-conflicting duties required by the County Executive or County Legislature.

Section 16.03. Deputy District Attorneys and Staff; Appointment; Revocation.

The District Attorney may appoint a confidential secretary and such Deputy District Attorneys, assistants, investigators and employees of his office as shall be authorized by the County Legislature. At the time of his appointment, and throughout the term of office, each such Deputy District Attorney shall be and remain duly licensed and entitled to practice law in the State of New York. Any such Deputy District Attorney appointed shall have all the powers and duties of the District Attorney. Each such appointee shall be directly responsible to, and, unless otherwise required by law, serve at the pleasure of the District Attorney. Appointments, and revocations thereof, shall be in writing and reported to the Commissioner of Personnel.

Section 16.04. Acting District Attorney.

The District Attorney shall designate in writing, and in order of succession, the Assistant District Attorneys who shall be Acting District Attorney in the event of his absence from the County or inability to perform and exercise the powers and duties of his office. Such designation shall be filed with the County Clerk and the Clerk of the County Legislature and may be revoked at any time by the District Attorney's filling a new written designation and order of succession. The Acting District Attorney shall have all the powers and perform all the duties of the District Attorney.

Section 17.01. Sheriff; Election; Term; Qualifications.

There shall be a Sheriff who shall be elected from the County at large for a term of four years beginning with the first day of January next following his election. At the time of his nomination and election, and throughout his term of office, the Sheriff shall be and remain a qualified elector of the County.

Section 17.02. Sheriff; Powers and Duties.

The Sheriff shall be the chief law enforcement officer for, and have jurisdiction throughout the County. Except as may otherwise be provided in this Charter, he shall have all the powers and perform all the duties, both criminal and civil, conferred or imposed by law upon sheriffs, and perform such other and related duties required by the County Executive or County Legislature.

Section 17.03. Undersheriff; Staff. Deputy Sheriffs and Staff.

The Sheriff shall have the power to appoint an Undersheriff and such Deputy Sheriffs, assistants and employees of his office as shall be authorized by the County Legislature. The Undersheriff, all Deputy Sheriffs, assistants and employees shall be directly responsible to, and serve at the pleasure of, the Sheriff.

Section 17.04. Acting Sheriff.

The Undersheriff, if any, shall succeed to the office of Acting Sheriff in the event of the Sheriffs absence from the County or inability to perform and exercise the powers and duties of his office. In the absence of an Undersheriff, the Sheriff shall designate in writing a line of succession to the office of Acting Sheriff. Such designation shall be filed with the County Clerk and the Clerk of the County Legislature and may be revoked at any time by the sheriffs filing a new written designation. The Acting Sheriff shall have all the powers and perform all the duties of the Sheriff during the period of his succession or until a new Sheriff shall be elected or appointed pursuant to law and shall qualify to assume that office.

Section 18.01. Board of Elections; Commissioners; Employees.

There shall be an Orange County Board of Elections constituted according to the State Election Law. The Commissioners of Election shall be appointed by the County Legislature in accordance with the State Election Law, and shall have and exercise all powers and duties now or hereafter conferred or imposed upon them by applicable law.

Section 18.02. Office of Probation; Director.

There shall be an Office of Probation headed by a Director of Probation appointed in the manner provided by the Code of Criminal Procedure. The Director of Probation shall have and exercise all powers and duties now or hereafter conferred or imposed upon him by applicable law.

Section 18.03. County Jury Board; Commissioner of Jurors.

There shall be a County Jury Board constituted according to the State Judiciary Law. The County Jury Board shall appoint a Commissioner of Jurors, who shall have and exercise all powers and duties now or hereafter conferred or imposed upon him by applicable law.

Section 18.05. Veterans Service Agency; Director.

There shall be a Veterans Service Agency headed by a Director who shall be appointed by the County Executive, subject to confirmation by the County Legislature on the basis of his experience and qualifications for the office. He shall and exercise all powers and duties now or hereafter conferred or imposed upon him by applicable law.

Section 18.06. Department of Consumer Affairs.

  1. There shall be a Department of Consumer Affairs headed by a Commissioner who shall be appointed by the County Executive, subject to confirmation by the County Legislature, on the basis of his experience and qualifications for the office. The Commissioner shall also serve as the County Director of Weights and Measures. He shall serve at the pleasure of the County Executive.
  2. The Commissioner of Consumer Affairs shall have all of the powers now or hereafter conferred upon him by law, rule or regulation including those provisions of the laws of the State of New York applicable to County Directors of Weights and Measures, and such other powers and duties as may be prescribed by Local Law or Ordinance.

Section 18.06B. Office of the Advisory Board. Aging; Director; Advisory Board.

For the purpose of better providing for the needs of the elderly, there shall be an Office for the Aging in Orange County. The head of such Office shall be a Director, who shall be appointed by the County Executive, subject to confirmation by the County Legislature. He shall be directly responsible to, and serve at the pleasure of the County Executive. He shall have all the powers and duties heretofore and hereafter conferred or imposed by the Laws of the State of New York, and such other powers and duties as may be prescribed by local law, ordinance or the Orange County Administrative Code. The .Director may appoint such Deputy Directors of the Office for the Aging as shall be authorized by the County Legislature. Any such Deputy Director appointed shall have all the powers and duties of the Director. Each such appointee shall be directly responsible to and, unless otherwise required by law, serve at the pleasure of the Director. Any revocations thereof, shall be in writing and reported to the Commissioner of Personnel. Within the Office for the Aging, there shall be an advisory board to be appointed in the manner prescribed by the Orange County Administrative Code.

Section 18.06C. Office of Community Development; Director.

For the purposes of providing and supervising Community Development programs in Orange County and assisting the local communities of Orange County in obtaining funds for Community Development Programs from sources other than County Government, there shall be an Office of Community Development in Orange County. The head of such office shall be a Director, who shall be appointed by the County Executive, subject to confirmation by the County Legislature. He shall be directly responsible to, and serve at the pleasure of the County Executive. He shall have all of the powers and du ties conferred or imposed by the laws of the State of New York, or the United States, or any local law, resolution or regulation of Orange County with respect to Community Development as may now or hereafter be conferred or imposed upon him by such laws, resolutions, rules or regulations, and shall perform such other duties as shall be assigned to him by the County Executive.

Section 18.07. Other County Boards; Appointment.

Except as herein otherwise provided, all other County boards, offices and agencies, including but not limited to, the Orange County Coroners, Mental Health, Mental Retardation and Alcoholism Services Board, the County Fire Advisory Board, the District Fish and Wildlife Management Board, the Alcoholic Beverage Control Board, the District Forest Practice Board, the County Agricultural Society, the County Extension Service Association and the Soil Conservation Commission shall continue as provided by law, except that the members thereof required to be appointed by County government shall be appointed by the County Executive subject to confirmation by the County Legislature. Boards, offices and agencies of the County whose functions are assumed by boards, offices or agencies created by express provision of this Charter shall, when not otherwise expressly provided, be deemed abolished as of the date of such assumption.

Section 18.07A. Orange County Police Advisory Board; Appointment; Powers and Duties.

There shall be within the County of Orange and Orange County Police Advisory Board, consisting of seven members to be appointed by the County Executive subject to confirmation by the County Legislature. Of the seven members first appointed, three shall be appointed for a term of three years, three for a term of two years, and one for a term of one year; thereafter, all appointments shall be for a term of three years. Vacancies in membership occurring other than by expiration of terms shall be filled by appointment of the County Executive for the respective unexpired terms, such appointments to be subject to confirmation by the County Legislature. Members of the Board shall include at least three chiefs of police of municipal police departments or police forces within the County of Orange. Members shall serve without compensation, but shall be reimbursed for the expenses actually and necessarily incurred by them in the performance of their duties within the limits of the appropriations made therefore.

The Orange County Police Advisory Board shall have the following powers and duties:
  1. to manage and furnish advice to the County Executive and the County Legislature on the implementation of programs to improve police services in the County;
  2. to recommend program priorities to any county police planner-coordinator who may hereafter be appointed;
  3. to approve countywide police training standards;
  4. to furnish police guidance in the operation of any county narcotics enforcement/criminal intelligence task force and other joint countywide police operations which hereafter may be created or undertaken;
  5. to advise the County Executive and County Legislature on the timing and degree of centralization of police technical services at the county level;
  6. to act as the police advisory body to the County Executive and the County Legislature, as well as to the governments of the several municipalities within the County.

Section 18.08. Additional Appointments by County Executive.

The County Executive shall appoint the County Historian, (County Fire Coordinator,) subject to confirmation by the County Legislature, and all other County employees, except as provided in this Charter and except that heads of departments established under this Charter shall be the appointing authorities in their respective departments for purposes of appointing employees in the civil service.

Section 18.09. Miscellaneous Administrative Functions.

Administrative units and functions not otherwise assigned by this Charter, the Administrative Code, or other act or resolution of the County Legislature, may be assigned by the County Executive to units within the County government.
